> == e bs Tans Rjaclalo y See ee ES La a VETA LOCA Pécceé ERO Bae os = == y el Lepernta Marto. ' Ts No one may be tried or punished for a crime for who has already been convicted or acquitted by a sentence/ firm in accordance with the law and criminal procedure/ of each country". 4?-The art. 6 of the European Convention on Human Rights--/ bre of November 4, 1950 declares: "andD, Every person has the right to have their cause seen equally tatively and Publicly within a reasonable time by a tribe/ independent and impartial body, established by law, -/ that will decide on your civil rights and obligations, / whether on the basis of any accusation in matters criminal offense directed against her. Any person accused of an offense is presumed innocent. until his guilt has been legally established--/ blecida. At no time was the principle of "equality of arms" that prescribes equality of means of defense. The -/ Ministry of Defense narrates its supposedly secret version/ of the facts before Parliament, which the entire Press collects, -/ Then there was the Minister who was happy about it; and it -- What is more serious, the Press claims to publish the summary, and the / Lawyers. After more than five months they still don't know him. 52” The constitutional principles of ---/ are not respected equality and respect for the dignity of the human person. The constitutional recognition of the dignity of the person who carries out the art. 10 of the Constitution has been con-/ violated by not allowing the Notary and the Confessor to vi/ siting one of the defendants, with presumption of innocence also-/ well recognized constitutionally. Another defendant has been transferred, arbitrarily and surreptitiously me, Without the knowledge of the Judiciary, they have been restricted/ discretionary visits, he has been transferred to more than / 650 kilometers from his lawyer, causing him to be defenseless, impirr"-/ giving normal communication between the Lawyer and his/her sponsored to a room full of humidity and with non-compliance with -/ hygienic-sanitary conditions that every human person has”/ ne law, “as well as the Regulation of “Peniten Establishments/ Military ciaries. A 6°- Lieutenant Colonel Tejero is ill, afflicted-/ rheumatism, in a military prison full of humidity and, thus-~/ same, from anemia. 7?- For completeness, the Establishment Regulations”-/ Military Penitentiaries does not attribute to the Ministry of Defense/ sa competence to transfer on his own initiative, but / that the initiative in any case has to be from the authority. Hi, competent judicial body (art. 59). 8°- The Ministry is only competent to give the order of/ driving. Now, the transfer has to be agreed upon by the au-/ competent judicial authority. This is also the constitutional criterion, since there is/ presumption of innocence and all defendants are found -/ under the exclusive dependence of the Judicial Power, not of the Power/ Executive» The Ministry of Defense cannot order, as it did =/ without prior request from the Judiciary the transfer and conduct--/ tion of a defendant to territory of different jurisdiction. The Hon. Mr. Antonio Tejero Molina, Lieutenant Colonel -/ of the Civil Guard, is under the exclusive dependence It is from the Judiciary who should have requested his transfer/ side. The Lawyer of the Ilmo. Mr. D, Antonio Tejero Molina es tes”/ you of the surprise of the Special Investigating Judge when he-/ heard about the transfer on television. The principles of equality and respect for the dignity of the human person, as well as the personality and. to/ moral integrity, included in articles 10, 14 and 2155de/ the Spanish Constitution. Likewise, the principles of the right to honor are violated,/ to personal privacy, humanitarian treatment and presumption of innocence, as well as the principle of freedom, collected in / Articles 17 and 18 of the Spanish Constitution, in article clause 10 and 14.2 of the International Covenant on Civil Rights and -/ New York Politicians, December 19, 1966 yen -/ art. 6.2 of the Convention for the Protection of Human Rights/ Nos and Fundamental Freedoms of 4-11-1950, Transfer more than 650 kilometers from your -/ Lawyer and the domicile of the Court, causes an obvious in-/ defense of the Ilmo. Mr. D, Antonio Tejero Molina, Lieutenant Choir/ nel of the Civil Guard, Furthermore, said transfer was not agreed upon by / “the competent judicial authority, but by an Organ of Power / Manifestly incompetent executive, by virtue of an act -/ null and void. 9?- Another important event is going to occur soon-/ when we were sent the six thousand pages that form/ case 2/81. At that time, the Lawyer of the Ilmo, Mr. Een D. Antonio Tejero Molina, Lieutenant Colonel of the Guard / Civilian, Mr. Angel López-Montero Juarez, will be in need/ ssidad., like the rest of the Defense Lawyers, of es--/ be in permanent consultation and change of arrangements with your Or > And that need. that. any of the remaining Le-/ trados has easily solved by finding all the prosecuted in the same jurisdictional territory of Madrid, will be a serious obstacle for the Defender of the Ilmo, Mr. D. A Antonio Tejero Molina, given the distance at which he Mantra, after its arbitrary and unconstitutional transfer to/ La Palma Castle. Creating in this way a total in/ defense, aberrant in any rule of law. We consider that the facts presented, due to their seriousness, constitute an important basis for Sif to be arranged the transfer of the Ilmo, Mr. Antonio Tejero Molina to A Alcalá de Henares Military Prison. For all the above SIULDELET C<AGMEOS 1?- That the constitutional principle of equal/ ity and the international procedural principle of "equality of --/ arms", enshrined in article 6 of the European Convention / of Rights of Man, of November 4, 1950. 22- That it be transferred to the Ilmo. Mr. Don Antonio Tejero Moli/ na, Lieutenant Colonel of the Civil Guard, to the Establishment -/ Military Penitentiary of Alcalá de Henares, where he had to be/ tar at present and from which he was transferred by virtue of a / administrative act null and void, issued by Organo -/ manifestly incompetent, and which constitutes a real oh arbitrariness and misuse of power, It is justice that we ask for in Madrid, on the twenty-eighth of June. issue of nineteen eighty-one. > == e bs Tans Rjaclalo and See ee EN The a VETA LOCA Pécceé ERO Bae os = == and Lepernta Marto.
