Ausoria General
Excmo. Sr.:

a

SUBJECT: WRIT PROMOTED BY MR. JOSE CID FORTEA

Hon. Mr.:
For the representation of Mr. JOSE CID FORTEA, prosecuted in
Case No. 2/81 that is being investigated due to the events that occurred
two days last February 23 and 24, it is formulated before the Hon.
Mr. President of the Government, on July 7, next
do the written attachment in which he pleads be considered filed
Appeal for Replacement, prior to the Contentious-Administrative, with
following the Resolution of this Ministry, of June 29, 1981, and,
At the same time, the Hon. Mr. Minister
2/E
of Defense, in accordance with the request that he formulated in writing of
date May 19 previous.
1887/C
The error from which the writing in question begins, results -
evident: just read what is described as "Resolu
tion" of this Ministry, to verify that it is not such, but
a simple communication of a request to the interested party, in order
that he complied in his letter - dated May 19, -
1981 - which for this purpose was returned - to certain require
procedural matters expressly provided for in Decree 1408/1966,
of June 2, Adaptation of the Adminis Procedure Law
treatment to the Military Administration.
This being so, that is, not being an administrative act
treaty that definitively resolves none of the issues
tions raised by the interested party in his aforementioned letter of 19
of May, it is seen that there is no room for a contentious-admin appeal against him
nistrative, as provided in art” 37.1 of the Judiciary Law.
risdiction, of December 27, 1956, and, therefore, the qualification
ceded as "Replacement appeal" for which it is inadmissible
As there is no prior resolution, the Administration that, directing
tatly or indirectly, has decided on the merits of the matter and
that is not susceptible to ordinary appeal through administrative means.
goes.
On the other hand, and regardless of the inadmissibility
cessation of the document that concerns us as a Resource for Replacement, it is
warn that the interested party does not comply with the requirement
I believe that on June 29, 1981, this Ministry informed him
you6. And in the face of such behavior, it is worth highlighting that the
art” 71 of Decree 1408/66, of June 2, cited above, provides
ne that if the document initiating the procedure administers
tivo did not gather the data indicated in art” 69 -as Su

does so, it will be archived without further processing.

Consequently, the contumacy of the interested party in not complying

assumption contemplated by the invoked article of the Administrative Law
