jero - Comandante Pardo Zancada (hoy).

"INFORMATIVE NOTE
SUBJECT: ORAL HEARING OF 2/81 OF THE SUPREME COUNCIL OF MILITARY JUSTICE.
DEVELOPMENT OF THE SESSION CORRESPONDING TO 03-10-82.
The session begins at 10:07 a.m. The interrogation continues
General Armada's speech concluding his shift, which began yesterday,
Colonel Escandell and successively Messrs. Quin
tana, De Miguel, Labernia, López Silva, López Montero, Martín -
Fernández, García Villalonga, Sanz López, Zugasti, Captain Caba
llero, Commander Pardos Aldea, Mr. Sanz Arribas, Tent Soler, -
Segura Fers, Lieutenant Colonel de Meer, Mr. Esquivel, Mr. Gómez
García, Mr. Liñán, Mr. Muñoz Perea, Mr. Ortiz Ortiz, Mr. Parade
la, Lieutenant Griñón, Mr. Nieto and Mr. Novalvos.
Nil Mr. Novalvos asked for a ten minute break to put
in order your notes. Request granted by the President.
Once the interrogation of General Armada was concluded, the Co
Ronel Escandell (defender of Lieutenant General Milans del Bosch]
asks the President to practice confrontation, behind closed doors, between
his client and General Armada. The President denies the request
tion together with the Prosecutor. This attitude provokes the protest of 18
defense lawyers.
At 5:50 p.m. the President adjourned the session until
10:00 am next Wednesday.
INCIDENTS AND ESTIMATES ON THE DEVELOPMENT OF THE SESSION.
The session seems to confirm the defenders' techniques -
both in form and substance.
General Armada, in general terms, has been questioned ~
following two different lines: A moderate one, in which
They have their own defender and Messrs. Quintana, Labernia, López
Silva, Martín Fernández, García Villalonga, Sanz López, Zugasti,
Commander Pardos Aldea, Mr. Segura Fers (with energetic intonation)
ca), Lieutenant Colonel de Meer, Mr. Esquivel, Mr. Gómez García,
Mr. Liñán, Mr. Ortiz Ortiz, Mr. Paradela, Lieutenant Griñón, Mr.
Grandson and Sr, Novakvos.
And a hard line made up of Colonel Escandell, the
Mr. López Montero (in the role of authentic prosecutor), the Cap-
tán Caballero, Mr.* Sanz Arribas, Lieutenant Soler and Mr. Pe
rea.
The actions of the Prosecutor, mistreated in some comments,
seems to follow the premise that under no circumstances can -
appreciate in his behavior a slight inclination towards such positions
antagonistic like the present ones; apparently maintains a
aimed at ensuring that both defenders and defendants in their
interventions reveal a reality that certifies
rá.
In the morning interrogations it is necessary to highlight the
Mr. López Montero's ability to find a weak point in the
General "Navy. Thus, when asking specific questions with demands
lack of concrete answers, the General was no longer the same,
I couldn't tell the whole story, going back in time, -
that answered everything and nothing. (This appreciation led to comment
to a journalist "Armada against the ropes").
The interrogation of the accused General Armada by
the defenders, has moved along two general lines: that of the
who defend the defendants from less responsibility, who are
move in order to demonstrate his not guilt based on obe--
due diligence and the fact that the Lieutenants of the Civil Guard
vile were included in the pact by which it was resolved
the occupation of Congress; and the rest, who try to show us
bring the quality of “political director of the operation by
of General Armada, and induce doubt in the Court that his situation
extreme silence may be due to his attempt to hide what he
intended as a possible royal inspiration.
An attempt is made to extend responsibilities to various personalities.
for their conduct during the hours following the occupation
of Congress, for its omission to adopt some type of me
measures; tending to quell a situation of rebellion.
It has been recorded that the statements of the Gene-
ral Navy are in contradiction with a large number of de-
statements from people not precisely linked to the "group -
Milans", such as Lieutenant General Pascual, Mr. Laina, Mr.
Harguindey...etc.
It highlights the fact that giving the password "Du
that of Ahumada” to General Armada, could only have as
objective to allow access precisely to the hemicycle already ~
that no one was required to enter the building in any way.
setpoint.
It has become clear that the intention of General Arma-
when he proposed himself as President of the Government, he did not fit -
within a stratagem to resolve the occupation
armed Congress, but considered it as a solution
longer-range and with future viability in the order of
lithic.
Among some military commissions it is commented how wrong
gives the performance of some defenders of Lieutenants of the Guard
Civilian who in their interventions seem to pay more attention to support
of other lines of defense than highlighting the supposed subordination
tion of their clients, with the risk - in some cases - of indisposition
tense with the Court for its aggressiveness or insistence on reflecting
aspects of the national situation prior to 23-F.
OTHER FACTS AND COMMENTS.
His Majesty the King has been named specifically not me-
us 79 times in the same line as previous days.
Her Majesty the Queen has likewise been appointed no less
six times.
Tensions continue between the defendants: Lieutenant General
Milans del Bosch - General Armada (yesterday) and Lieutenant Colonel Te-
jero - Commander Pardo Zancada (today).
General Aramada has declared that he was dismissed on the afternoon of
24-F at the direction of the Acting President Mr. Suárez and -
of the Minister of Defense Mr. Sahagún. These extremes are
Lieutenant General Gabeiras reported.
Some defenders insist on publicly denouncing the situation
tion prior to 23-F, which they describe as a "state of necessity." -
The President of the Chamber normally cuts off these interventions,
although there is evidence of terrorist actions in the environment
tas of recent years. oe
