NOTA INFORMATIVA
to al Sr. Fiscal, 7 letrados defensores.
no seis.
go más.
Tejero.
tenido buen cuidadodenoinvolucrar a nadie.
do todas ellas producto de deducciones posteriores.
2.2.- Interrogatorio del Capitán de Intendencia Cid Fortea.
- A preguntas del Sr. Fiscal manifiesta:... No depender direc

48 minute period they use their right to ask questions, jun
to the Prosecutor, 7 defense lawyers.
The Councilors did not consider it pertinent to carry out
any questions during the session.
INCIDENTS AND ESTIMATES ON THE DEVELOPMENT OF THE SESTON.
2.1.- Interrogation of the Captain of the Civil Guard Pérez de
la Lastra, Lázaro Cortaiz and Bobis González.
- Mr. Prosecutor marks the line of action by asking
successively destiny and hierarchical dependence of the
ceased; knowledge that he has of the Lieutenant Colonel
Tejero, both personal and destiny on car day
and if he exercised direct command of force. Also if the interest
rogado had news about Operation Galaxy.
Below, through different questions,
the participation of the accused in the events of -
23F, the Prosecutor showing that the orders
nes did not come through natural command.
In the interrogation of Captain Pérez de la Lastra -
can be highlighted:
.. Nobody ordered him to go to Congress and it seemed to him
opportune to help in a serious situation.
.. The ironic nuance when citing the color of the buses--
ses used to move nearby |
of Congress: "...unfortunately now we have to -
change the colors..."
.. General Aramburu did not tell me to get on the
bus and return to the Park, If I had
Now the Prosecutor would have asked me for a year and a half and
not six.
During the early hours of the 24th I felt that we had been
victims of confusion, deception, entrapment or
go more.
.. Once the assault on the Congress was over, I went up to a co-
che in the company of Lieutenant Colonel Tejero, Captain
Sidewalk and Captain Abad. Here I heard Tejero saying: -
"General Armada comes to me with an airplane story
nes and two days ago he had given the order in the house
Juan Gris, to enter Congress."
. During the interrogation of the Captain of the Civil Guard
Zaro Cortaiz highlights:
.. Lieutenant Colonel Tejero ordered him to participate in a
public order service in the Plaza de Neptuno, with
knowledge and royal authorization.
+. I witnessed that Comapdantg Bonel said that all
The Captaincies except the 1% and 8% had given the bene-
platitude to the facts.
.. At the Carrera de San Jerónimo he found out that Milans was
the tactical leader of the operation.
. During the interrogation of Captain of the Civil Guard Bo-
bis González it should be noted:
.. Lieutenant Colonel Tejero, with formal request
which left no room for doubt, gave him the order to carry out
a public order service.
.. Who follows orders because the regulations require obedience
blind tooth
.. Commander Bonel expresses the support of the
Captaincies and that the formula presented by the General
Navy was constitutional.
.. Enter the glass room where the General
Navy and Tcol. Tejero talk and that's where it is-
The last thing he told him was that the other night General Armada
He gave him the order to act in Congress. Thus he deduces
than Tcol. Tejero was obeying orders from Ge
neral Armada because he did not object to this.
- Interrogation of the defenders.
+ Regarding Captain Pérez de la Lastra highlights:
.. Mr. Hermosilla's procedure to reveal
that the statement of Captain de la Lastra relates
goes to the Tcol allusion. Tejero on General Ar-
mada is new and was omitted from the Summary. In this --
sense refers to the coexistence in prison of the accused
with Colonel Manchado and Tcol. Weaver.
.. The rest of the defenders who take their turn
They emphasize that the defendants did not receive an order to
guna during the 23F so that they would abandon their attitude.
. In the one corresponding to Captain Lazaro there is a softness
general since in his responses to Mr. Prosecutor he has
Been careful not to involve anyone.
. In the interrogation of Captain Bobis González it is possible to
tacar:
He tells his defender that the hierarchical superior
co prima over the natural.
.. Mr. Escandell's substitute answers that the GAR.
was forming a cordon in Congress but in an attitude
which seemed more like protection to those inside.
.. Mr. Hermosilla in his line of bringing out
that today's statements regarding General Ar-
mada are new and did not manifest them at the time, although
all of them the product of subsequent deductions.
2.2.- Interrogation of Quartermaster Captain Cid Fortea.
- To questions from Mr. Prosecutor he states:... Do not depend on direct
mently of Cte. Pardo, although as a member of the Ge Barracks
neral is under the orders of the General Chief of the DAC through
of the General Staff.
. I didn't know Tcol before. Weaver. When trying --
exalting its supposed motivations is interrupt
I ask.
He did not attend the DAC leadership meeting, in which
the Cte. Pardo explained the events that were going to happen.
.. Once the assault on Congress was known, it appeared in the State
Major, ignoring the orders that were issued, as well as
the evolution of the situation, since their level of
information was always low.
«. He dined with almost all of the Chiefs and Officers -
of the C. General, being invited by Cte, Pardo to -
accompany him. The defendant recognizes that the invitation
It was to move to Congress. (Again, intending
to justify his decision with allusions to his conscience
cia and national situation, the President of the Chamber
short).
He did NOT command troops; only flat functions -
older.
.. Knowing the message carried by Colonel San Martín,
He stayed out of loyalty to Cte. Pardo and the Civil Guard.
- Interrogation of the Defenders.
To questions from his defender, Captain Cid Fortea mani--
party:
-. That the 180° change in a decision (exit of the -
DAC 1 - Alert 2, for quartering) produced
deep indignation, which resulted in his subsequent
incorporation into the Group of Cte. Brown to play
a testimonial role of support to the Civil Guard that
occupied ft Crete
That the DAC forces did not change the situation
already existing.
+. That after the message from Colonel San Mar-
Tin decided to stay out of loyalty to Cte. Brown and
Civil Guard, not included in the departure offer.
- The lawyer Barros de Lis - substitute for Colonel Escan--
dell - tried to get the defendant to show independence
dence of the facts of the DAC in relation to the action
of command of Lieutenant General Milans del Bosch, but the
The defendant only stated clearly that he believed that Cte.
Pardo, already in Congress, carried out orders from Valencia,
. He answers Mr. Hermosilla that he knows nothing about
tion to the General Armada.
. He expressed his indignation to Mr. Gómez García when
already arrested reads a version of the events in which
It was said that "the DAC column had escaped from the
quartering".
. The lawyer Mr. Muñoz Perez asks about the environment in
the DAC on the 24th, but due to the intervention of the President -
The question is suspended. The lawyer protests, for the purposes
of cassation, and another joins. It appears in the minutes.
+. The Lt. Griñó asked him about Art. VIII of the Constitution.
tution and its relationship with the facts and situation.
The rest of the defenders resigned, as did the
members of the Chamber, to ask questions'
3.- OTHER FACTS AND COMMENTS.
- Today H.M. has been summoned. no less than 19 times,
despite the fact that the President of the Chamber has considered im-
some pertinent questions that would have arisen,
possibly more citations.
- This morning at 10:18 a.m. it was distributed among
military commissions, inside the Chamber, the following
telex you:
"On the 18th, the mayor of Valencia invited the Capi-
General, together with other Authorities, to witness
the "Mascleta" from the Town Hall and then to have a -
paella in the hut installed in the same Plaza del Ayunta
I lie.
And while there, Mr. Carrillo introduced himself, who greeted
those present, among them the Captain General, and left the
local immediately without taking anything at all.
Therefore it is totally false that there was an invitation
to a paella by the Captain General, nor was there any conversation.
sation between the two."
Some defendants and family members have congratulated the Captain -
of Mayor Cid Fortea for his attitude in the statement.
Among those prosecuted, the tensions of previous days are
-at least apparently- more controlled.
In general, interest in the development of
the view; the attendance of journalists has been lower; by
Several regular lawyers were also missing in the afternoon.
Among attendees, a statement by the Captain was discussed.
of the Bobis Civil Guard, in which he says he has kept
