N/Rfaa. C/ SG//55.4.644/6024-04/- 8P2p .TOR ASUNTO: VISTA ORAL 2/81 DEL CONSEJO SUPREMO DE JUSTICIA MILITAR. Armada. Esto se lo dijo a él. No re- cuerda horas.

After a 30-minute break mid-morning, the interrogation continues The President adjourned the session at 2:10 p.m. In the afternoon the interrogation of defenders continued - until 7:15 p.m., despite the request of some of them for applause zar the view at 6:00 p.m. But the President decided to end the witness and he has done so. INCIDENTS AND ESTIMATES ON THE DEVELOPMENT OF THE SESSION. Lieutenant General Gabeiras, when asked by the defenders, sores, has adopted, from the beginning, a cautious, precarious attitude life and suspicious, always fearful of falling into any con tradition. For this reason he has opted, on many occasions, for refer the defenses to what was stated in their written statement. ta, so numerous questions, mainly those regarding to specific times or data, which the defenders wanted to see confirmed. madas, have been avoided by the witness with the same answer: "The answer is what is stated in my written statement," with which the Court and the public, who do not know the summary, have remained unaware. This observation has come to be made... in the afternoon session by the President of the Court. However, at the request of the various defenders, the most Interesting of what was stated has been the following: 2.1.- To Mr. Escandell, defender of Lieutenant General Milans of the -- Bosch and Coronel Ibañez: - It is not true at all that General Milans approved the Band publication. - He disagrees with the defender about the time he went to JUJEM. - You have not clarified, despite the insistence of Mr. Escandell, the reasons why he did not reiterate to General Caruana the order to arrest the Captain General. He has insisted that for him it was It is enough to know that the Governors and other Authorities Military would not obey him. - He has stated that it was sufficient reiteration to have -- made to come to Madrid. - It is not true that, after an initial arrest, he was incommunicado nicado, having always treated him according to his category estuary 2.2.- To Mr. Hermosilla, defender of General Armada. - He does not remember when he decided to appoint the 2nd Army General -- JEME, not even when he told him, although he indicated something to the - send it to Lérida. - It does not clarify with whom the 22nd Section of the EME was dispatched, yes - directly with him or with the 22 JEME, since there was variation on this, but cannot specify dates. - Never, on the night of February 23, did he capture anything that indicated indisci pline or supposed help to the rebels, on the part of the General. Navy, which always assumed the line of Command. - Authorization for the General Armada to move to Congress It was only to manage the exit, but in no way (and this has been repeated countless times) to propose-- as President, since this was unconstitutional. nal. .= “He did not hear” General Armada speak with General Juste although then, under pressure, he acknowledged that he had knowledge of such call and does not remember if it was held in his presence. But, of In any case, he didn't find out what they talked about. - Nor did he hear him speak with General Milans, and no one mentioned him. mentioned this conversation, upon his return from JUJEM. - He never spoke to the King about the "Armed solution." - It is not true that when the General Armada left for Congress put himself at his orders, and the phrase that was used is not true either. blames him, on the occasion of the dismissal of said General in the sense that he was sorry, but had been pressured, and "those who We hold political positions... etc." - An alleged telex from the OIDREP to EFE and another to the EU is unknown. ROPA PRESS on the dismissal of General Armada. Just recognize a later personal note from him. - The phrase cited in his statement stating that he did not leave the General Armada to be absent from his office "by intuition and "Command practice" does not imply any type of suspicion, but rather . only: desire to have him close to help him. = He returned to his office, from JUJEM, because 61 PREJUJEM He told him that "something strange was happening" without further information. Here it is pro- produced an incident that is narrated later; but it is signi It is important to point out that he later accepted that he had been - said: "the actions of the General Armada are not at all clear", and for that reason he returned; in the afternoon he again denied this second 'phrase. 2.3.- To Mr. López Montero, defender of Tcol. Weaver: - The lawyer began by asking the lieutenant. General yes co did not know the graduation of his client, a question that has been vetoed by the President as inadmissible, arguing the lawyer who did it because the deponent always said - only "Tejero", which seemed to indicate that he did not know the graduation. There has been controversy about this with the Prosecutor, perhaps making the atmosphere very tense, and with this characteristic - has developed all this interrogation. - The most outstanding thing about the witness' statement was -- been: > >. - Refusing to answer the first three questions because they allege that he had already done it before. Nobody told him that, upon entering Congress, Tcol. Weaver in will call out the name of the King. Anyway, there wouldn't have been -- believed, having already spoken with H.M. He gave orders to Colonel Alcalá-Galiano to reduce Tcol.. "by any means" but "without victims." It does not clarify the con- tradition that the Prosecutor appreciates between the two sentences. Until 6:25 am I did not know anything abnormal in the DAC u -- other Units. Does not clearly answer the defender's specific question on whether he sent any force to protect the person of H.M. - He has rambled about the Units under his Order or those of the Ca General Pitán, talking about how they were alerted. But the - defender has managed to record that there should not be posed a real danger to Zarzuela when he did not worry was able to send protection. He dismissed the Captain General of the 3% Military Region for repeated obedience. He is not aware that he was obeying of the King's Orders. He did not call Valencia asking for a password for the Congress. It was General Milans who told him about its existence, although only He notified the Army General. This was said to him. Don't re- rope hours. I didn't know there were 147 guns in Congress. but it was his constant concern that there be no violence. 2 He does not want to affirm or deny whether General Armada, upon returning = of Congress told him that Tcol. Tejero had spoken to him- to convert it into another Sanctuary. He claims that the truth is - what appears in your declaration. He does not know, nor was he interested, the reason why they cut the - communications in Congress. - He does not answer the question about whether he knew if General Fer- Nandez Campos had authorized the General Armada to go to the Con- returned "in a personal capacity" to offer himself as President. In-- It is true that he did not authorize it, but the specific question - He doesn't answer it. - And he also does not respond clearly when asked if he knew -- that the message taken to Commander Pardo was from real company. He claims that he was not interested in such a note. - He rambles about what he wanted to express when talking about "benevolen- "cia" for the exit of Congress. . - Understand that "the hood document" did not exclude at all to the Lieutenants. This statement has been repeated by numerous times throughout the day. - He did not find out about Mr. Laina's intentions in pretending take a child from Tcol. Tejero to Congress. - They did not read him, nor were they interested in the Side of General Milans To Mr. Sanz Arribas, defender of Captains Cid Fortea and 2.4.- Bobis González. : - On the night of cars and until 10:30 p.m. he took personnel mindfully note the hours in which the events took place foundations and from that moment on they were taken over by a General Officer whose name is not given. - Faced with the dilemma that it has greater value if the note in- formative of 27-F or its only declaration contained in the Summary it is stated that the latter. - General Armada only speaks on the phone with the General - Milans when he refuses to have any relationship with the witness. This attitude does not cause any surprise. - He refuses to express the Orders he received from H.M. yes pe - General Armada never stayed during the events of - 23-F, as JEME, only took provisional charge of... office in the space of time that General Gabeiras - He was in the JUJEM. - The instructions given by General Armada, before the - first negotiation of this with Tcol. Tejero, they were from - convince him, intimidate him, ..., and then offer. - General Aramburu informed him of the Royal Navy proposal. lized by himself to Tcol. Tejero after the conversation tion of both in the glass room of Congress. - The phrase "at your orders President" is absolutely false - To the question: "Are you the expected military authority?" in Congress" the witness considers that it is inadmissible. you. - He affirms that his intention to go to Congress accompanying the General Armada's sole purpose was to deceive the Tcol. Te- jero, but given the refusal of the second JEME he gave up his wish. - I heard that the proposal made by the General Armada to pre seek a Government that would put an end to the retention of funds Damn, it was a sacrifice he offered for Spain. - He ordered that the National Police not prevent the passage of the -- column commanded by Commander Pardo to avoid an en-- confrontation. - The dismissal of General Armada was communicated by the witness. - The decision to dismiss General Justé was the declarant's for sufficient reasons. 2.5.- To Mr. Novalvos, defender of the Lieutenant of the G.C. Boza Carranco. - The interview Commander Pardo with Tcol.F.Gémez de Salazar, had the intention of solving everyone's Problem (Guardia Civil and DAC). - The conditions of surrender ("hood" document) are Tcol.F.Gómez de Salazar communicated and it is at that moment when he brings them to the attention of the PREJUJEM, to whom he informs So he had no problem accepting them. - He affirms that his opinion the exculpation does not include the Teniens tes. - That he would have done everything possible to ensure that the offer of planes and money were met if necessary. - Justice is responsible for determining compliance or not the conditions agreed with the assailants. 2.6.- Interrogation of other defenders. - In the afternoon session almost all the defenders participated. remaining elements, but in a repetitive manner, so collect together the answers given to them, although It is only worth highlighting, because it has not been said before, the following" +. General Milans suggested that he study the possibility possibility of entering Congress by force, but it is not necessary scam. . He refuses to clarify what he meant by saying that he intended to go to Congress to "deceive Tejero." The explanation can be seen in his written statement. . He arrested General Torres Rojas for the mere fact of being in the DAC alleging false reasons to his Captain General, and Do not return to Coruña immediately after entering the Congress, but waited to be ordered. . Regarding the reasons for the dismissal of General Justé, he does not let him -- answer the President. - He insists that General Armada, upon returning from Congress He did not inform him that he had tried to run for President. That's why he didn't tell anyone or proceed to arrest him. +. He is not aware that there were two planes prepared in Getafe at 8 p.m. And he doesn't know if the General Armada knew it. . The 22nd, 52nd and 72nd Military Regions knew only what he he told them. He doesn't know if they knew anything in advance. «He recognizes that at four in the morning there were troops in the streets of Valencia, ignoring the reason, and is not able to - explain it. +. He authorized Pardo's column to be allowed to reach Congress. The reasons were to avoid confrontations. . That night he did not find out that Captain Batista had gone to the radio. He found out three days later. +. He does not remember if General Aramburu told him that in Congress there was no They paid attention to him. + He did not want to say who the General was who took note of what happened that night. 2.7.- Interrogation of the Prosecutor. He has hardly asked any questions, the only thing worth highlighting is the referring to the fact that he heard the Army General tell the King and the General - Fernandez Campos who wanted to go to Zarzuela, and that the General - Milans only withdrew the troops several hours after ordering- the S.M. 3.-OTHER FACTS AND COMMENTS. Today's session can be considered one of the most interesting. due to the peculiarities it has had and which are related below. nuation: - The impression that could be obtained was that General Gabeiras was .the accused, the defenders, his accusing prosecutors, and the Prosecutor halfway between defender and advisor to the President. - It was impossible to distinguish who was defended by each lawyer.Almost none have exercised direct defense of their sponsored, and thus they have dedicated themselves to systematically attacking you to the witness in a practically inconceivable way. - Lt. General Gabeiras began, as has been said, like -- cautious, but also angry and even arrogant, which It produced indignation in public and commissions. but to measure that the session has passed, and in the face of harassment from the lawyers two, he has calmed down, he has armed himself with patience, he has endured magnificently and has earned all kinds of sympathy and - admiration - Despite his statement, the defendants did not like it, - mainly to the Generals, Colonel Ibañez, and others, who have shown their rejection on different occasions, reaching even to appreciate how they called him the son of... and other ca similar meanings. - But the real protagonists have been the defenders, - who have shown how one should not lead a defense.
