midad, acompañado de su Jefe de IM. Coronel San Martín;
desde dicho lugar vió al Gral. Armada en el patio del -
acuartelamiento.
Par
do.
bierno.
Con relación a la frase del Gral. Gabeiras dirigida al
Gral. Armada: "A tus ordenes mi General", contesta que
no lo oyó, es más, que no es cierto. :
Hubo momento en que el Gral. Gabeiras manifestó su de-
seo de acompañar al Gral. Armada al Congreso, pero des~
conoce la causa del cambio de opinión.
Después de las negociaciones entre el Gral. Armada y el
Tcol.

INCIDENTS AND ESTIMATES ON THE DEVELOPMENT OF THE SESSION.
2.1.- Testimony of the TG. Sáez de Santamaría” Passed public
yesterday's incident, the President of the Chamber
gives the interrogation turn to the remaining lawyers
1
who successively refuse to ask any questions ~
(19 defenders).
The President grants the use of the floor, in his turn
no, to the Prosecutor, the witness stating the following:
- That Cte. Cervera, who could not dissuade Tcol. Te-
jero stated that he said: "Let him tell that to the
Army General who had given him an order the day before ~
to occupy Congress".
- That Tcol. Tejero threatened to light fire on the -
National Police if the cordons were removed =~
Civil Guard.
- What the General Armada said, in relation to his proposal -
4 of the provisional government: "It is constitutional." Also
: He stated: "There has to be a sacrifice here and that is
“General Armada.”
- The Army General also stated that the 5th and 7% Re-
Military regions followed the 3rd.
The Councilors declined to ask questions.
To Testimony of General Juste:
Summoned by the President of the Chamber, he appeared after
a brief wait, going to his place, where he swore
ment and responded to the general provisions of the law.
This witness has been summoned at the request of the
following lawyers: Messrs. Hermosilla, Quintana, López Mon
tero, Zugasti, De Meer, Gómez García, Muñoz Perea, Sanz
Arribas and Segura, who successively interrogated him.
In summary, General Juste declared the following:
That on February 23, around 10 a.m., after
He initially came to BRIPAC to attend a conference.
moration before traveling to San Gregorio, where he had to prepare
complete some exercises on DAC Units.
Because he did not have the required uniformity, he waited a few
50 minutes in the office of the General Head of BRIPAC, -
while they were trying to solve the problem of uniformity
mity, accompanied by his IM Head. Colonel San Martín;
From that place he saw the General Armada in the patio of the -
quartering. What Colonel San Martín thought -
that he wanted to stay for the subsequent "cup". what
decided to continue the trip, and since the pa
Medinaceli rador -where the EM. of the DAC. I had to give him
news - continued to Santa María de Hurta, from -
where the Colonel called the EM. of the DAC., stating
that something was happening and they had to return, without further specification.
Well, as Colonel San Martín told them, he did not want
I didn't give details because I believed he had the DAC. intervened
telephones (This was commented on in the EM. for
some time, although the General did not give it much importance,
although with his means he tried, without result, to verify
it. I couldn't guess what military or civil service could -
perform the alleged intervention).
Around 4:50 p.m. they arrived at El Pardo, looking in the patio
before General Torres Rojas in uniform -and a group
type of Chiefs and Officers-; the first one explained that there was ~
been invited to eat by his former subordinates. Ya
Inside the building, Colonel San Martín gave him
jo that there was an important matter and asked permission to ~
that Cte. Pardo would expose it. (To General Juste I ex--
brought the presence of General Torres Rojas in uniform
and found it normal than his MS boss. expose the topic).
Knowing this, the General declares that from the first moment
ment had mental reservations and decided not to lose
the command of the DAC. (He remembered an episode that occurred in -
1936 in Melilla). The mental reservations were based:
+ That the General Armada had not told him anything.
+ In that the missions of others were not made known to him
Madrid units (BRIDOT, BRIPAC, etc.).
+ In the allusion to the Queen seeing the operation with good
eyes. (Remember the exile of Princess Sofia with goose
sion of the military coup in Greece).
- And in the reluctance when he tried to contact him
Chap. General of the 1% RM, ("I gave it to General Quintana
estuary to the TG. Milans").
He gave his consent for the drafting of Model Orders
mission, preparatory to the occupation of objectives. -
(Remember that in the list of Objectives there were al-
some parking areas -Plaza de Castilla, Plaza
del Oeste- and mcs., but there was no newspaper).
At 6 o'clock he called the Zarzuela and the
suspicions. Then he called Capt. General, of the 1% RM., and --
then to the JEME, but he only managed to speak with the General.
Armada, which at all times seemed to him to be acting as
2nd JEME; does not remember that he expressly disavowed
the use of his name. Nor did he hear any more invocations of the -~
name of the Army General than that formulated by Cte. Pair
c.
He did not give an order to retain the troops at the time of pa
Seo, but it seems appropriate. He did not give an order to leave
Units, although some understand that he could interpret as
mo such the consummation of the "remarkable fact" (Assault on the Con
return).
General Torres Rojas placed himself at his orders and remained
had liabilities after he, implicitly,
accept and assume the instructions of Valencia Communi
falls: through Cte. Pardoyantes the G.T. Rojas had bet
lled on the legitimacy of the Operation.
Later he gave counter orders to the Units, to -
that they were quartered and those that had left for
for them to return: He asked for news, and they did not include him -
Among the departures is that of Captain Bastista. He found out

nes, and told the defendant that he did not consider the visits illegal.
tell some friends, that the incident was unrelated to the case, and that
He didn't think it was necessary to tell the judge. (This
statement apparently is contrary to what was stated by
the Tcol. Gibert, from EM. of the DAC., which is why the
defender Mr. Zugasti requested a confrontation between General Jus
te and Tcol. cited).
Without specifying a time, he stated that throughout the years he
Chos spoke about 6 times with Zarzuela, with the TG. Gabei
flush, with the TG. Elícegui, with General Armada and General. It is
chivias. He spoke with General Milans around 7:30, as
Colonel Ibañez has testified, not to ask for information
instructions, but information about what was happening in Va-
lence.
He didn't find out or give permission for me to leave -
the column of Cte. Brown. He found out through a -
transistor, almost at the same time as Captaincy. Captaincy
They summoned Colonel San Martín to attempt the re-
return of the column .and carry a message from Zarzuela.
He did not know its content.
He did not initially spread H.M.'s message. then
It came as a telephone message addressed to his authority; then,
When they told him to, he did so.
He did not know the conditions of surrender until
They were communicated by Cte. Pardo upon rejoining the Barracks
General. It was the Captaincy that ordered no; proceed
ra against the Lieutenants.
From the Heads of your MS. processed had a magnificent
ca printing before 23-F. Afterwards not because of the hidden
maintenance of information, which conditioned everything
sea decisions. They did not grant him "Useful time" to give
Orders.
He again insisted that the "Monday" Order was not given
61.(Apparently there is a contradiction with what was stated by
the then Colonel Valencia Remon and the Tcol. Sanz Este
ban; The lawyer Mr. Muñoz Perea requests a confrontation between
each of the aforementioned and General Juste).
That day, according to the declarant, the behavior in -
The General Staff was abnormal. And remember that specifically
there were no objectives for the PM Companies. and General Headquarters
ral and believes that Orders were given in his name without his --
consent; He accuses Colonel San Martín of dis--
loyalty for the delay in informing him of the content of the -
trip of Cte. Pardo to Valencia, of his subsequent departure
to Congress, of the departure of Captain Batista, of whom
It was the boss who had invited General Torres Rojas.
Li” Testimonial evidence of General Castro San Martín requested pox
the lawyers Mr. Hermosilla (General Navy), Mr. López
Montero (Tcol. Tejero), Mr. Sanz Arribas (Cap. Bobis and -
Chap. Cid Fortea), Tcol. defender of Meer (Cap. Dusmet),
Mr. Gómez García (Capt. Alvarez Arenas), and Mr. Muñoz Pe-.
area (Cap. Pascual).
It is carried out under oath, indicating the witness who has
ne friendly relations with any of the defendants. The
President asks if that prevents him from telling the truth,
who answers negatively so he can perform his
statement.
As a whole, General Castro San Martín affirms the
next:
- He is a classmate and has a close friendship with -
Army Gen.
- 23-F arrives between 7:15 p.m. and 7:30 p.m. to Cuar
General of the Army. The Army General was
in the office of General Gabeiras.
The actions of the General Armada at all times were co-
rect and disciplined to the Orders of the JEME. in mine
ments in which he was in charge of the office due to absence
of General Gabeiras, was always accompanied in the
pacho by General Officers.
The General Armada suggested going to his office to simplify
phone calls, but Gen. Gabeiras told him
He said it was better to stay with him.
Through the General Armada and the witness it was transmitted
"ALERT 2" to the General Captaincies.
The Army General never made any supportive comments
to the rebels.
Approximately half an hour before. return of the --
JUJEM of Gen. Gabeiras, Gen. Armada had a con
telephone conversation, of long duration in which
tataba: "... it's nonsense... I'm not qualified...
etc." Later he told him that he had suggested
Gen. Milans to propose a government presided over ~
for 61, and if they authorized him he did it. Given the proposal
General Gabeiras was upset and asked those gathered
the opinion. The witness thought that the solution did not
was constitutional and could be dangerous in the long term for
the monarchy. Geheral believes: - Castro San Martín that
Next the JEME called the JUJEM and the Zarzuela.
It was clear that the responses received were
negative rum. The specific position of General Gabei-
ras was reflexively negative. The value of authorship
Zarzuela's statement on the "Armed solution" could
be very relative: on a personal basis "do what you know."
Subsequently, the declarant believes that there was a moment
when everyone left the office at the request
of Gen. Gabeiras and he and Gen. were left alone.
Navy. Afterwards, the 2nd JEME marched to Congress without the
authorization to propose his presidency to a new Go~
bierno
In relation to the phrase of General Gabeiras addressed to

The statement of General Castro San Martín has had

OTHER FACTS AND COMMENTS.
Before starting today's session, General Urrutia has gathered

remind you that your presence in the Room is an act of Service,
and that the corresponding formality must be maintained, without manifests

sion of the President of the Council towards the withdrawal of the acre
additions to them.
After some efforts by General Toquero, the fact -
It was settled without major consequences.
- Also this morning we could see the great disappointment
tion of the journalists because when the hearing began it was not -
had called the attention of the defendants in the same way
