NOTA INFORMATIVA
go, D. Arturo Garcia-Vaquero Salazar, D. Félix Porras Blanco y D.
Emilio Bonelli Otero.
Esteban, Gibert Crespoy Corral Rodriguez.
Generales, principalmente si deben llevar faja o no --
* * 2.3.- TCOL D. Arturo Garcia-Vaquero.- División de Operaciones
- Allí no vió nada destacable.
- Su actuación, como toda la DAC, fué "por obediencia a su}
So-
lo intervino para asegurar el apoyo del. Rey.
2.8. - Interrogatorio del TCOL D. Fernando Sanz Esteban.- Regimen
to Villaviciosa 14.
Por ello or-.
2.9.~ In .s Gibert Crespo.
to más lentitud.

INFORMATIVE NOTE
SUBJECT: ORAL HEARING 2/81 OF THE SUPREME COUNCIL OF MILITARY JUSTICE.
1.- DEVELOPMENT OF THE SESSION CORRESPONDING TO 04/16/82
Interest in today's session has been as low as that of -
previous days. The statements, without being so repetitive, are not -
have provided news of interest, with the exception of the one provided -
by the TCOL Mr. Eduardo Fuentes y Gómez de Salazar, who during -
the last hour and a quarter of the morning he made a declaration-- -
tion of some relevance. Prior to it, and in between
short events have deposed as witnesses the Choir
nel Mr. Fernando Sancho Garcia and the TCOL,s Mr. Manuel Muller Hidal
go, Mr. Arturo Garcia-Vaquero Salazar, Mr. Félix Porras Blanco and Mr.
Emilio Bonelli Otero.
In the afternoon the TCOL,s Pardo de Santallana,Sanz testified |

The defenders of all the Lieutenants have joined. After expressing
the prosecutor who did not share such a conclusion, although he did not oppose the
request for freedom, the President has said that the request be made--
formal written submission for the Court's decision.
2.- INCIDENTS AND ESTIMATES ON THE DEVELOPMENT OF THE SESSION.
2.1.- Interrogation of the witness Colonel D. Fernando Sancho Garcia.
This Chief, who was assigned to the Permanent Secretariat,
te of the Superior Council of the Army, and therefore depended -
2 of General Armada, has not provided any information of interest --
new to the cause. The only thing worth mentioning that MEN SSeS has
has been:
- I didn't go to Headquarters until 10:30 p.m.
= Allg practically didn't find out anything important.
-= You were not allowed entry to the Secretary's office
of the JEME, as it is strictly prohibited.
2.2.- TCOL Muller Hidalgo, Assistant to General Esquivias.
Nor has this witness contributed anything new, he also arrived
around 10:30 p.m., by order of his General.
- He occasionally saw General Armada but he doesn't know anything about him.
what he did or spoke.
- Firmly assures that both the aforementioned General and his assistant
Dante was wearing a white shirt and black tie when he left.
Congress and upon return.
-Despite having been in Ayudan's office for a long time--
The JEME's officials did not see or learn about almost any of the
sas declared by this Helper.
= Ha | statement by the Counselor
General Morillo being interested in the uniformity of the
Generals, mainly whether they should wear a sash or not --

tion.
* * 2.3.- TCOL Mr. Arturo Garcia-Vaquero.- Operations Division
of the EME.
Without his statement having anything relevant either, he
its surroundings have been more interesting than the content
nest of what is manifested,
He entered the room crossing himself, and squared himself
vigorously before the defendants before doing so before
the President.
He has expanded by saying that he knows and has worked with
several of the defendants, and "he wants to implicate all of them"
ably, especially in these painful moments….”
Here the President has cut him off.
After that, and with various interruptions due to evil --
performance of his microphone," he said as notable
the following:
- Dispatched with the General Armada on 23-F from 5:40 p.m. to 5:55 p.m.,
time in which he was called by the JEME.
- From there he went to his office where he stayed until 10:00 p.m.
flush, not giving importance to a phone call from his
wife notifying him of the 'assault on Congress.
- He was in the Assistants' office until 11:30 p.m., and in
That time he did not see or hear anything of interest, although he knew
the rumor that General Armada had gone to Congress
to propose a coalition government.
- Around 11:30 p.m. I went to his home, along with quite a few
Generals and Chiefs by order of Lieutenant General Gabei-
ras. The President won't let him answer the question --
from Mr. López Montero on the JEME's reasons for --
such order.
- He has stated that General Armada was wearing a shirt and tie
ta khaki, and the Adjutant white shirt.
2.4.- TCOL Mr. Félix Porras Blanco.
This Chief, possibly cited for his long years of -
destiny in the Civil Guard has stated, at the request of
the defenders, who knows the officers of the Guard
“Civilian defendants, who have a great opinion of all of them--
nion, that obedience in said Body is always real and
blind and that Orders given by telephone are frequent
and the missions entrusted to the students of Centers of -
Teaching.
In addition to the above, it can be noted:
- He arrived at his position at Headquarters at 2200 hours,
at the direction of their bosses. :
- He didn't see anything notable there. Only quotes comments from --
some that he heard, but without specifying.
- He assures that, on the 24th, Captain Abad told him that
TCOL Tejero, after speaking with General Armada in the
Congress, told said Captain that "the General
had betrayed."
- He didn't see anyone taking notes in the Assistants' office.
- Considers that an officer of the Civil Guard, in situ--
available, you can receive orders from your commanders
for any mission.
2.3, = TCOL Dis Emilio Bonelli Otero.- Captaincy Staff - |
General, First R.M.
The interest of this witness lay in having been the Je
faith that accompanied Colonel Sanmartín to carry a message -
to Commander Pardo in Congress.
But such interest has been disappointed because it has not --
contributed nothing: does not know who inspired the message, does not know
what it contained and only learned of the Commander's refusal.
Dante Pardo and the Captain to accept it.
The President of the Court has not allowed him to respond to |
TCOL Meer's question about whether the Captains, with such -
attitude, they complied with the ordinances, which has caused
the protest of said defender.
- It should be noted that he came to Congress because he could not do so.
through the upper part of the Carrera de San Jerónimo, through
from the Plaza de Cibeles, where there was no police cordon
cial, and where no obstacles were placed.
- It had no relationship with the TCOL Tejero in Congress.
- He did not try to convince any Chief or Officer of the Army.
or the Civil Guard to stop their attitude, for
That may not be the mission that was entrusted to him.
2.6.- TCOL Mr. Eduardo Fuentes y Gómez de Salazar.- Division of -
EME intelligence.
He has narrated in great detail, despite the reiterations
given warnings from the President, his participation in the
negotiations for the abandonment of Congress, which may re~
plunge in this way:
- He proposed to go to Congress to his natural Chief, and he -
was given by the JEME, through the Army Generals and
Arraz—
Tra} amburu went to Congress and
day. Or, that he explained to him the con-
conditions to leave. In them the Teniens were exonerated

He verbally explained these conditions to the General Director
of the Civil Guard, and this, after telephone consultation,--
stash that "the Command approved them all," and sent him to work.
tar with the TCOL Tejero,
He returned to Congress. He wrote the conditions of the DAC in
a piece of paper as a reminder to talk to TCOL Tejero,
and he exposed them to him, who accepted them (after speaking with “=
his Officers) after making some clarifications that the
TCOL Fuentes wrote.
Upon leaving the Congress he found the Generals Armada and
Aramburu. He told the first one that the Civil Guard -
accepted the same conditions as the DAC. The General -
Armada retired with the written paper, to study the --
conditions. After that they entered Congress and there, = |
Without the presence of the declarant, the document was signed. |
And two lines were added, which he believes was done by
the Assistant to General Armada, although he cannot affirm-

He wrote down details of the conditions on a piece of paper to

intended to be a document of capitulation,
The pact to leave Congress was verbal and the intention

Dante Pardo than for those of TCOL Tejero. |
It is not explained how there was an error when signing the word su-

me or TCOL Tejero. Regret the mistake.
There was never any intention to exchange or negotiate with the deputies.
ted to improve the conditions of the pact since -
They were never considered hostages since they were
the first to leave Congress.
The reason for exemption from responsibilities to the Lieutenants
of the DAC was because they did not have direct command.
He does not remember the uniformity of General Armada.
He can't say where the components were facing --
of the security cordon formed around Congress.
The President considered the questions inappropriate -
of the lawyer Mr. Ortiz "in a pact of honor between military
res, if one of them breaks the pact, he breaks his honor"? and
Whose fault is it that the Teniennes are prosecuted?
of the Civil Guard"?
'He verbally and fully communicated to General Aramburu the -- |

noncommissioned officer scam" clarifies everything.
- When asked by a Councilor if in his conscience the
Lieutenants of the Civil Guard are exempt from responsibilities.
bility answers that the treatment is the same for both.
2.7.- Interrogation by TCOL Mr. Fernando Pardo de Santallana.
Lieutenant Colonel Pardo, firm, calm, sure of -|
himself and categorically in his statements he has stated:
- General Juste always commanded the Division and no one called him
objections.
= Colonel Sanmartín did not give 6 orders, something unusual in 61.
- He thinks that "there was no confusionis among the members of the DAC
mo, insecurity, enthusiasm or hesitation. Just faith in
the commands, permanent virtue of the officers who, in -|
stellar moments, and this one was, it comes to light.
- His actions, like the entire DAC, were "out of obedience to his"
Chief and: at the Service of the King". Normal service in the FAS,
and not exceptional at that time.
- Commander Pardo Zancada called you from Congress to |
to tell him: "I want you to know that I have come here for the ~-
of Spain and I want you to know it. But in no
moment he asked for help of any kind.
- The order given was for immediate compliance.
- General Torres Rojas did not have active participation. So-
intervened to ensure the support of the. King.
- He does not know exactly the reasons for the Captain's departure
Batista towards the "Yoz of Madrid" |
2.8. - Interrogation by TCOL Mr. Fernando Sanz Esteban.- Regime
to Villaviciosa 14.
He attended the DAC Commanders' meeting in the absence of the
Colonel Chief of his Regiment, and the most notable of the mani
celebrated has been:
- TCOL Sanmartín barely participated.
- General Juste always held command, and approved the
“orders from his E.M., which seemed to be improvised.
- The Orders were immediately enforceable. Therefore or-.
He ordered his Squadrons to leave towards the marked objectives.
= General Torres Rojas did not intervene. Just to offer-
to General Juste, and reaffirm the King's approval.
2.9.~ In .s Gibert Crespo.
The aforementioned TCOL, belonging to the E.M. of the DAC, which

- After this statement, the lawyer Mr. Zugasti has withdrawn
the request for confrontation that had been presented between the
General Juste and TCOL Gibert.
2.10.- Interrogation by TCOL Mr. José Corral Rodriguez.
The questions addressed to this Chief of the Ci-
vile have all been directed in one direction: to affirm that
That afternoon he saw several Civil Guard officers
outside the Congress and none of its natural Chiefs
He ordered to stop his attitude.
On the other hand, it is normal in said Body to receive Orders
telephone calls and comply with them, even without sometimes knowing -
the exact content of the same at the time of departure.
He did not see the aforementioned officers do anything that would imply
support for the rebellion, and his general attitude was always consistent

As concrete facts, it has not contributed any worthy of
mention. He has only assured that he saw him leave the Con-
