NOTA INFORMATIVA
2.- INCIDENCIAS Y ESTIMACIONES SOBRE El DESARROLLO DE LA SESION.
a obrar,
razones: exigencia ética; lealtad hacia sus subordinados;
to recibido del CESID, extendiendose en consideraciones so
—
IBAÑEZ actuó ajustado a derecho obedeciendo siempre Órdenes

The session begins at 10:06 a.m., with the intervention
of Lieutenant General CABEZA CALAHORRA, co-defender of the Lieutenant -
General MILANS DEL BOSCH, which takes 55 minutes to raise the
moral basis on which he orients his judgment, the actions of
his client. -

- minus the 20 minute break - when reading your writing -
of defense in favor of General MILANS and Colonel IBAÑEZ,
In the afternoon session, the Colonel's intervention continues
SCANDELL until 5:37 p.m., when he takes the floor
the 'Lieutenant General DE SANTIAGO Y DIAZ: DE MENDIVIL co-defensor
of Colonel IBAÑEZ, spending 30 minutes in his argument.
2.- INCIDENTS AND ESTIMATES ON THE DEVELOPMENT OF THE SESSION.
2.1.- Intervention of General CABEZA.
General CABEZA began his intervention, continuing
peppered with literary and journalistic quotes, with the, -
desire to draw the attention of his listeners to the month of Faith
February 1981 and the circumstances then existing.
After a review of the causes, which in his opinion, generates
ban the tension of the moment (terrorism, military politics -
erroneous, insults to the Flag, irresponsible political line.
ble, ....) enters fully into the examination of two aspects with
creeds: The responsibility of the Armed Forces, and the -
specific causes that motivated General MILANS DEL BOSCH
to work,
Regarding the first, examine Art. 8 of the Cons.
titution and the Royal Ordinances, and the responsibility that
the FAS. maintain the normative aspect, rejecting the
classification of coup plotters that the accused receive; contributes
among others the examples of the French Army in recent times
cients.
Regarding the second, the co-defender justifies the -
intervention of General MILANS DEL BOSCH based on four
reasons: ethical requirement; loyalty to his subordinates;
the consideration that the Homeland is above
of the State and finally, the belief in acting by order -
of the KING.
After condemning what he calls the "parallel campaign to
trial'" founded on the cliché '"destabilization of the demo
cracy", shows his fear that the truth cannot be known--
never cease, and ends his intervention with a call
to politicians, the media and the military
young tasks, so that the adjustment of the Forces is achieved
Armed with society
And Intervention of Colonel ESCANDELL.
Next, Colonel ESCANDELL, defender of Gene
ral MILANS DEL BOSCH, takes the floor to express his do-
ble satisfaction, as a soldier and lawyer, and salute the Tri
bunal and the Public Prosecutor's Office for their painful duty.
After clarifying the outline of his defense, he raises to define
tives its provisional conclusions and recalls the serious--
reality of the situation that Spain was going through in 1981.
Considers that Art. 8% of the Constitution is a --
historical constant that the Army must interpret without re
pre-established regulations, and that Generals MILANS and AR
MADA were not immune to the existing problems.
The defender continues, disagreeing with the story of --
the facts presented by the Public Prosecutor's Office, consider
which developed like this:
In 1979, General ARMADA began his contacts with the
General MILANS, to whom he conveyed the serious concerns
of the KING, and already in November 1980, General MILANS himself
He personally requested an audience with the Monarch, without being required.
laughed later
On 01/10/81 it was General ARMADA who first called
to Valencia, and then, he met with General MILANS, at
who again spoke of his conversation with the KINGS in Ba-
I wanted
These conversations decided General MILANS DEL
BOSCH to intervene, considering that it was a --
wish of H.M. On this basis, the meeting of the --
18.01.81 in Madrid (C/. General Cabrera, 18), to which the
General ARMADA could not attend, and in which there was talk of --
"redirect any action that was supposed to be 'bloodless'."
A consequence of the above are the various visits
that Colonel IBAÑEZ performs to General ARMADA, first
in Lérida and then in Madrid once appointed 2nd JEME.
Aspect of interest is the defender's refusal to
consider the previous meetings of Lieutenant Colonel MAS with
the Lieutenant. Colonel TEJERO, without accepting that the first
at no time does he represent the General AR
MADA.
He then remembers that his client, after knowing
the interview that Cte. CORTINA prepares between Lieutenant 'Co
Ronel TEJERO and General ARMADA on February 21, 1lama
to the latter and that is when he finds out that the planned action
will occur on 02/23/81. Although this date seems pre-
kills General MILANS, provokes the trip to Valencia of
Cte. PARDO on the 22nd and gives you a background of what pre--
seen, and in his presence, speaks on the phone with the General
ARMADA, who tells him that the events will be produced -
in Zarzuela, and asks that General TORRES be notified -
RED,
The events of the 23rd are accepted in the version of the
Prosecutor with some qualifications. So, remember that the Choir
In IBAÑEZ he was directly employed by General MILANS
due to his greater seniority in the E.M. of the Captaincy
General, but Colonel IBAÑEZ informed General URRU--
TIA -Head of the E.M. - as ordered by the Captain General.
He then goes on to justify Operation Turia --
-security of routes and barracks- motivated by the in-
form that you receive from the Valencia office of the CESID, and co
mo in the face of threats to the Civil Governor to remove the masses
to the street by the head of CC.00., it starts
the operation with the code "Miguelete", to maintain the or
den in Valencia.
When analyzing the evidence, he states that the Court has
had been denied 80% of what was requested, which almost caused
a state of helplessness. After relating the evidence of-
denied, makes available to the Chamber a letter from the Choir-
in PARDO DE SANTALLANA -current Military Attaché in Germany-
nia- and two letters from two Assistants of General MILANS.
The first is based on accusing General ARMADA of pe
tell General MILANS, -when they were both arrested in
Madrid - that he did not mention the events prior to the
February 23; The second ones serve to fix the three
calls from the KING to General MILANS, which places on the --
01, 02 and 04 hours on the 24th.
On this basis, the defender questions the data -
contributed by Generals GABEIRAS AND FERNANDEZ CAMPOS in
relation to other alleged calls from the Monarch to the Gene-
ral MILANS, which serves its purpose of stating that its
defended obeyed the KING at all times.
He then goes on to justify in detail the placement
implementation of the Tactical Groups on the basis of the document
received from CESID, expanding on considerations
—
about the qualification: C-3 of the Informative Note, in relation
with the Campaign Information Regulations, to finish
remembering that, having received the order from H.M. -at 01.00 am-
close to the 24th - the forces from Valencia withdraw before -
of the Real message on TVE. Thus ends the morning session.
ñana
In the afternoon, Colonel ESCANDELL continues with the analysis.
analysis of the evidence and attempts to reveal the inequalities
xaccuracy of the statement of General GABEIRAS in relation
with the time in which the forces entered Valencia and also--
well because General MILANS did not speak with H.M. The King until
01:00 hours on February 24,
Below is an in-depth analysis of the
telex from His Majesty to General MILANS putting special emphasis on
emphasis on certain phrases such as ".... it will not be able to be heard..."
and ''...whoever rebels...'" to which he gives an interpretation
warning about future events, which is intended to
to reveal his tone not of rebuke but of caution--
tion. He then goes on to consider the manifestos issued.

Then carry out the legal considerations
undermined to demonstrate that there is a total absence of rebellion. In
essence, Colonel ESCANDELL reveals that there was in
General MILANS mistakenly believed that the King was the Su-
premo and therefore there is an impeding element for the configuration
ration of the crime of rebellion.
The defense lawyer makes some different considerations.

IBAÑEZ acted in accordance with the law, always obeying Orders
of General MILANS and this one of the King.
Since the actions of their

2.3.- Intervention by Lieutenant General DE SANTIAGO.
Complement Colonel ESCANDELL's argument with theses
about the environment and motivations that induced, how he is
of necessity, to the development of facts and attitudes of a
sector, possibly the majority, to make use of the article
eighth of the Constitution. He asks for the acquittal of Colonel IBAÑEZ.
OTHER FACTS AND COMMENTS.
General ARMADA has been transferred to a different room.
the one it occupied until now, located at a certain distance
to avoid incidents that were apparently expected to continue in
contact with the rest of the defendants.
Simultaneously, it seems that there is an exacerbated attitude of
animosity towards Commander CORTINA and Captain GOMEZ IGLESIAS -
also by some of the defendants.
During the intervention of Lieutenant General CABEZA CALAHORRA,
ABC journalist Pilar Urbano was visibly upset
ta for some allusions, and tried to get some more journalists -
together with her they would adopt an external attitude of rejection.
