CESID intelligence note on the 30 April 1982 session. Counsel Hermosilla Martín (defending General Armada) continues and concludes reading his defence brief. Quintana Alarcón (defending Colonel Torres Rojas and Lieutenant Ernesto Milans) then intervenes. Hermosilla rebutted the Prosecutor's account of the King's role on 23-F night, arguing Armada would never take the initiative without royal authorisation; he compared the case to the Dreyfus affair given the absence of witnesses against his client.

NOTA INFORMATIVA
ASUNTO: VISTA ORAL 2/81 DEL CONSEJO SUPREMO DE JUSTICIA M(LITAR.
Seguidamente, aporta numerosos testimonios tendentes a demos
General FERNANDEZ CAMPOS, Sres. DOPICO y BALLESTEROS, Coronel -
cipio "in dubio pro reo".
a "obediencia debida".

INFORMATIVE NOTE
SUBJECT: ORAL HEARING 2/81 OF THE SUPREME COUNCIL OF JUSTICE M(LITAR.
1. DEVELOPMENT OF THE SESSION CORRESPONDING TO 04/30/82
At 1004 hours the session begins, continuing with the lawyer
Sx. HERMOSILLA MARTIN -defender of General ARMADA COMYN- with
the reading of his defense brief, which ends, when he has
consumed seven hours of eminently technical intervention.
The lawyer Mr. QUINTANA succeeds him in the use of the word.
APARICIO, defender of General TORRES ROJAS, and Lieutenant NU
ÑEZ RUANO, beginning at 1336 hours the intervention of the Ge
neral CALZADA ATIENZA, military co-defender of General TORRES -
ROJAS, who requests that the Chamber interrupt his argument, when
When the President threatens to withdraw his permission. When starting
in the afternoon he resigns.
The President then grants the floor to the
Mr. DE MIGUEL, lawyer defending Captain MENENDEZ,
Commander PARDO and countryman Mr. CARRES who exhibits until 1735
when the session adjourns.
2. INCIDENTS AND ESTIMATES ON THE DEVELOPMENT OF THE SESSION.
2. Mr. HERMOSILLA. He began his speech with a review of -
the aspects presented yesterday, and after disqualifying
as a means of proof, the letter from Colonel PARDO DE SANTALLANA,
notarized and provided by the defense of the Gene-
ral MILANS, summarizes that the conduct of General ARMADA during
on February 23 and 24, 1981, does not present any appearance
reprehensible
Thus the second call that The KING makes to General GABEI-
RAS - around 7 p.m. on the 23rd - and asks about his defense.
do, is caused by the call that General JUSTE had -
made previously to the Zarzuela asking about the General
NAVY. The KING speaks with General ARMADA and orders him to stay
was in the EME, and if it was offered to the Royal House, it was done at =
personal title for the relationships he had always had,
without at any time taking the initiative. For the defender
sor, the news that General ARMADA is engaged in
the military operation, comes from someone still unidentified,
and since there are no witnesses, he cannot be convicted. (Gives the example
of the Dreyfus case).
Next, he provides numerous testimonies aimed at demos
Tran, that his client is not initially mentioned in the
facts and thus reviews various witness statements (partici
pants at the meeting of the Armored Division, testimony of the -
General FERNANDEZ CAMPOS, Messrs. DOPICO and BALLESTEROS, Colonel -
ALCALA, General PRIETO, testimonies from Valencia,... etc.), with
the purpose that his client applies the principle
cipio "in dubio pro reo".
Next, and after analyzing in depth the crime of -
military rebellion, rejects that his client is included
in it, accepting at most, that it appears as a con-
speculation, which in the opinion of the lawyer does not intervene in the evidence.
ba, the only valid condition when sentencing.
Entering fully into what is called the second part ~ that is,
the direct intervention of General ARMADA, affirms his lack of
connection with the first, the military operation-, with the intention--
tion of demonstrating that his client did not have the initiative of his
acts when approaching Congress to dissuade Tcol. TEJERO.-
His action was initially requested by General ARAMBU--
RU once failed in their attempt at mediation; and later
te, by General GABEIRAS. Regarding Tcol. TEJERO, it's obvious
who does not receive General ARMADA as a boss, but as a man
ideal for its categorized relationships.
The lawyer insists on a point that he considers fundamental:
General ARMADA, before its mediation in Congress, requested
permission from Zarzuela and JUJEM that was granted to him, and -
He exactly complied with the limits imposed on him, which are:
put a plane at the disposal of the attackers to Congress and --
manage the release of the Deputies in their personal capacity.
After extensive considerations on the term "at the discretion of
the personal" and the dependency relationships of his client
At that moment, the lawyer ends by stating that General AR
MADA took over an "official mission" in a flexi context
ble, his acts being subject to the legal norm, that he, in no way
some moment compromised. :
It is interesting to highlight at this point that Mr. BERMOSILLA, throughout
Throughout his speech, he interspersed numerous historical antecedents.
torics and cases of jurisprudence, in support of his defense.
Next, the defender analyzes the circumstances of the
days 23 and 24, examining the anomalous nature of certain decisions
shadow of the Constitution (direct orders from the KING, interven-
tion of the JUJEM, Board of Undersecretaries,... etc) and as the Ge
“neral ARMADA consulted the Constitution and believed it was acting at sea”
co of the same. Thus, the so-called "Armed formula" is nothing more than a
attempt to convince Tcol. TEJERO to free the Dipu
ted, and not to the supposed action of forming a Government that does not =
came to Formulary that is why, General ARMADA tells the sa
lir that "his mission has failed" since he has not managed to convince
cer al Tcol. TEJERO, a very strange thing if he had been his boss
in the operation.
The lawyer concluded by saying that the "ARMED solution" was
a constitutional formula and, furthermore, the only one that was proposed
that night to resolve the situation, and his client did not
He acted worse than the others.
Regarding these reasons, the lawyer requested, due to lack of evidence,
the acquittal of his client.
Intervention by Mr. QUINTANA
He began his speech by thanking the Court and re
rejecting the popular judgment that is practiced by certain press.
Next, he rejects the Prosecutor's explanations and his -
qualification of the facts, facts that he does not try to justify,
but in which their clients are not involved.
Divide General TORRES's participation into two parts
ROJAS: Attendance at a meeting on General Cabrera Street, and
his stay in the Armored Division during 02/23/82.
He attended the first at the invitation of the unknown General MILANS.
finding the reason for it, and there, he understands that it has been -
chosen to fulfill a mission commissioned by the KINGS, co
placed that remains suspended until further order; not included
ye the General's contacts with the Tcol. TEJERO in Galicia,
Well, they were held in prison and with witnesses.
The second intervention of his client begins when he is
telephoned by Commander PARDO about the -
1100 hours of 23-F, and urged to appear in Madrid, and pos
later at the Armored Division Headquarters.
' Upon arrival at the DAC, General JUSTE is invited to participate.
peer in the meeting, and there remains unrestricted his authority
Ld
until confirmed -by the call to the Zarzuela del Gene-
ral JUSTE-, that H.M. He doesn't give him any orders, he goes back to his -
destiny and places himself at the orders of his Captain General.
The defender tries to establish a. parallelism between
actions of Generals JUSTE and TORRES ROJAS, and there was no
evidence, his client must be released; alternative-
mind, it must be valued with the same absolute sense in reason
to "due obedience."
In relation to Lieutenant RUANO, he also denies the re-
relation of the facts and the qualification of the same facts.
the Prosecutor lists.
His client receives the first news when he is forced
to get on a Corps bus, to complete a service
that he ignores the Orders of his natural commands; in his -
opinion, 95% of the force that came to Congress was deceived
nothing.
He then denied that his client was involved in
the incident with General ARAMBURU - rise and subsequent ba-
guards of the buses parked in Congress, and
his alleged threats to the General - and in this sense he contributes
testimonial verses, to conclude by stating that the doubts -
They serve to prosecute, but do not produce a conviction.
After reaffirming that Lieutenant RUANO's activity was
led to the Orders of his natural commanders, remember that the -
witness Tcol. GOMEZ DE SALAZAR included the Lieutenants in the
pact, for which he requests the acquittal of his client.
23. Intervention by Division General CALZADA, co-defender of the -
General RED TOWERS.
He structures his argument in five points:
1,- History reminder of General TORRES ROJAS. here
highlights the brilliant service record of the
General as the key to why General MILANS
called for the meeting on January 18. In it the General
TORRES ROJAS lent its consent to any mission
that in the future would be entrusted to him.
¿2 Analysis of the constitutional mission of the FAS. In -
This part, in the co-defensor's own words, performs
a study of the constitutional mission of the FAS. with
the technique of the General Staff, to conclude that its
sponsored acted out of "due obedience" to
Your Majesty.
3.- Features of the national situation on the day of cars
mo triggering factor,
When analyzing the situation, the "State of Necessity" arises.
is based on a broad doctrinal description of the sub-
revolutionary version, citing an inventory of Acts
terrorists who intend to achieve a Spain
Marxist and Soviet.
The President requests that General CALZADA stick to the
theme of the defense of General TORRES ROJAS.
Ss codefensor continues with another of the triggering factors
Nantes: the Separatisimo. Given this situation, the President
I peed at you again to warn you to stick to
the defense and that the next time he withdraws the use of the
word.
This situation causes the request for suspension of the
view to reorganize the defense, which is granted.
In the afternoon, General CALZADA resigns to continue, ~
alleging helplessness for his sponsored and doing --
record your protest for the purposes of cassation. They adhere
other defenders. '
This resignation has prevented the punctures from developing
4th and 5th of the argument relating to the analysis of some
us triggering factors of the situation of 23-F
and the conclusions.
Intervention of the lawyer Mr. DE MIGUEL defending the Captain
of Navío MENENDEZ VIVES, Commander PARDO ZANCADA and civilian
GARCIA CARRES,
+ He begins his presentation with a series of general considerations
rales relating to the function of the Court, peculiarities
queen it and conditions of all kinds that ro--
dean the entire process. This has allowed him to slip phrases
of compromised content linked in a way that would make
relatively difficult to interrupt him.
It refers to the fact that one of the functions of the Council is
know the facts and therefore who? because? and pa
why? they carried them out.
Consider the possible limitation that for a military Court
tar supposes the imperative of obedience, in concurrence with
that of independence, and cites the possible existence of conditions
extrajudicial agents.
He alludes at a certain moment to what he calls "forum -
of the hyenas", a qualification that he assigns not explicitly
you to the press.
Disagrees with the execrable description that has been given to
the facts and argues that in any case they have not been --
more than - those of Pavia who gave rise to the restoration -
monarchical
He goes on to briefly mention a series of circumstances
that occurred from the beginning of the procedure as the
appointment of a Special Judge, a fact that qualifies as
constitutional and refers to some removal produced --
which he defines as "more discretionary than discreet",
It exposes the existing socio-political climate in Spain in the pe
period prior to 23-F, including phrases such as: "the need
ity gave wings to separatism"..., and..."regarding the ve
similarity of the royal impulse"....
Cite the motivations that could have decided the action.
They believed they obeyed the KING. It does not rule out the possibility that
was the result of a "machination of agents"
"provocative" and makes some speculations about the intention
rationality of the provocation. He talks about the fact that on 23-F there was =
three characters in search of an author, the III Military Region, -
the DAC and the Civil Guard.
“Recognize that someone is obviously not telling the truth and recognize
rope that LAINA thought about the arrest of ARMADA and that -
GABEIRAS distrusted his 2nd boss,
He highlights that the action project of 23-F had been con-
considered bloodless and takes the opportunity to cite the fact that
There was a great distance between Congress and Paracuellos.
Mention in order ARMADA's confidences to MILANS in
Valencia, the presence of CORTINA on Pintor Juan Gris c/
and the fact that GOMEZ TGLESTAS endorses TEJERO before the Co
ronel MANCHADO, emphasizing his membership in the CESID.
He makes a consideration to the Court in relation to the -
value of certain testimonies, in clear reference to an ale
previous cat of Mr. HERMOSILLA, alleging that in certain
