NOTA INFORMATIVA
ASUNTO: Vista oral 2/81 del Consejo Supremo de Justicia Militar.
Ls DESARROLLO DE LA SESION CORRESPONDIENTE AL 04-05-82
norma;
la tarde de autos;
so. '
Or-
dido y el TCOL. Tejero;
las fuerzas que intervienen con el TCOL. Tejero el 23 F;
No
cífica, no ha aportado ni un solo punto relevante. ;

INFORMATIVE NOTE
SUBJECT: Oral hearing 2/81 of the Supreme Council of Military Justice.
THE DEVELOPMENT OF THE SESSION CORRESPONDING TO 05-04-82
The arguments of General Chamorro Martín and Mr. have taken place.
López Silva, co-defender and defender of the colonel of the Civil Guard
Manchado García.
Then the lawyer López Mon takes his turn as the defense.
tero, lawyer for Lieutenant Colonel of the Civil Guard Tejero Mo-
lina, who does not conclude his argument, being postponed to Conti-.
nuar in tomorrow's session.
INCIDENTS AND ESTIMATES ON THE DEVELOPMENT OF THE SESSION
2.1 Intervention by General Chamorro Martín, co-defender of the co--
Civil Guard ronel Manchado García..
His argument consists of a preamble, thesis and request for -
pity
In the preamble, the general declares himself a lawyer, a doctor in
political science and sociology, non-military family, -
people and builder of their own worth; cites their destinations as
general officer; and is surprised by the worry, during the
view, which the Public Prosecutor's Office has for:
- General Milans's foresight in having prepared the -
side. The co-defender declares that he has always done it
like this. Also remember that in the time of the Republic cra
norm;
- that General Torres Rojas was in uniform to the DAC in
the afternoon of cars;
It is also strange that the Prosecutor does not adopt any insist---
to know the cause of the presence of the gene's countryman--
ral Santa María at the Palace Hotel.
In the thesis, he first makes a disquisition on the figure
of the co-defender in the new code, which he describes as confusing
sa and obtuse; continues with the belief of a possible future
appearance « The Military; call, -with
sorry- Red Army to the Republican Army; and enters' enu-
review the points on which his defense is based.
These are:
a) Colonel Manchado, in the proceedings, depended on the Directorate
General of the Corps, and it was she who reproached him, on occasion
sions, for requesting explanations of the Orders received.
b) Command of the GC Automobile Park was cumbersome.
so. '
c) Colonel Manchado did not intervene in the occupation of Con-
return. He limited himself to giving to TCOL. I gain strength to fulfill
provide a service. These Orders, he had the belief, pro-
transferred from the Director General and were endorsed by a --
man from CESID, Captain Gómez Iglesias.
.d) He received orders to appear at the Palace Hotel to his Di-
rector The colonel is in fatigues. For this and
because the municipal cordon prevents it, he decides to return
.to the Park to change. There they arrest him. It was not breached--
ment of Orders -continues the co-defender- but impossibility-
ability to fulfill them. |
Furthermore, General Chamorro shows that other mi-
higher-ranking literaries proceeded in an analogous manner as
their defendant and are not prosecuted.
The general ends his argument by stating that the colonel
Manchado acted out of love for service and following orders. Or-
denes that corresponded to the state of tension that was breathed.
ba then, and now, in Spain.
Because everything stated above does not fit into the crime of rebellion,
not even in negligence, and in the face of a clear action of
due obedience, the co-defender requests the free absolution of the
Colonel Manchado.
2.2 Intervention of the lawyer Mr. López Silva, defender of the choir--
Manchado Garcia Civil Guard cell.
Structure the defense in two parts: one, the entire performance
of Colonel Manchado in the record, minus the fact of not presenting
to the General Director at the H. Palace, which constitutes the
second part
To do this, Mr. López Silva begins with the presentation
of the GC Automobile Park as an organizational error.
tion. Thus he deduces that the forces that accompanied the TCOL. Te-
jero did not all belong to the Park and, therefore, their boss did not
It was Colonel Manchado.
He continues with his version of the events, among which stands out-
ca than the TCOL. Tejero asks Colonel Manchado for buses
and strength invoking the King and the generals Armada, Milans and
Aramburu. At this point the lawyer expands on how
that are required and provided services in the Civil Guard.
Then read the Prosecutor's story -referring to Colonel Máncha-
do-, to then dissect it into paragraphs and not agree
I agree with him on:
- that the friendship between his defender constitutes a crime
dido and the TCOL. Weaver;
- that the Head of the Automobile Park is head of all
the forces involved with the TCOL. Tejero on 23 F;
- that at the meeting Colonel Manchado, TCOL. Tejero, captain
Abad, will the La operation be explained in detail?
occupation of Congress.
Yes, he agrees with the Public Prosecutor's Office that the cap-
tán Gómez Iglesias confirms what was said by the TCOL. Weaver
It was true.
"Based on these reasonings, the defender deduces that the
The defendant acted convinced of obeying legitimate orders. No
there is rebellion.
Strengthens his argument by establishing his defense in parallel
with that of Commander Pardo Zancada. Compare the attitudes of
the colonels of the DAC with that of their patron: those
They limited themselves to carrying out orders without checking them and... they are not -
prosecuted... because without a doubt his behavior was correct.
So, says Mr. López Silva, it cannot be done in justice
require different behaviors in the same situations, and in fact
This is violating article 14 of the Constitution, which -
places all citizens equal before the Law.
In relation to the second part of his thesis, the lawyer -
He concludes that General Aramburu is lying. The
Colonel Manchado was not called by the Director General of the
GC to withdraw force from Congress, but to ex~
explain his behavior to his boss.
In conclusion, he affirms that in the conduct of the accused there is no
there is rebellion because it does not incur the requirements that the typi-
fican. Therefore, he asks for free absolution. Furthermore, with ca-~
secondary character, due obedience is applicable. that
is an excuse, so the same conclusion is reached: Jibre
absolution.
And it's more. Mr. López Silva says: none of the prosecutes--
two have incurred the crime of rebellion, since they do not ~
have incurred malicious criminality. To prove this statement
mation develops the theory by which the characteristic of
crime is that there is malice.
The lawyer also extends himself into doctrinal theory, ex-
put yesterday by Mr. de Miguel, of the powers that the
Constitution 'grants to the King.
2.3 Intervention by Mr. López Montero, defender of the lieutenant co-
ronel of the GC Tejero Molina.
In the prologue, after stating that we will all be judged
two by History, shows that the root of the -
acts done by men that are judged is in their —-
military honor.
He refers to the press as the fourth estate and assigns it
indicates a powerful, overwhelming influence, capable of pouring
torrents of insidiousness upon those sitting here.
He then develops a historical-political report.
legal of the History of Spain, since the facts
of 23 F cannot be judged outside of the historical context.
_He then goes on to clarify a previous question which is the
challenge - already made at the time - of the appointment
of special judge of the case, for the purposes of appeals
that proceed in due course.
In the afternoon and for more than an hour and a quarter, he made a
presentation of the facts, as the lawyer considers that
occurred, starting from a first meeting in Cartagena, in
November 1980, and in which General Armada explored the
will of Lieutenant General Milans as a man loyal to the King,
to study the possibility that it was the tactical head.
After ensuring that there was no rebellion because they did not dissolve
the Cortes nor Congress was attacked, and only
parliamentarians awaiting the arrival of the Authority -
Military, Mr. López Montero has highlighted the great silences
"honourable" services, information gaps and contradictions
existing, which will make it very difficult to clarify -
the truth from the Court.
The last fifty minutes have been dedicated to inten-.
to convince, "without intending to bother anyone," that the gene-
ral Armada has lied, that he is the real head of the operation.
ration, that Commander Cortina also lies, and that the
TCOL. Tejero has done nothing more than fulfill a service, little -
less than routine, in the conviction that he obeyed the management.
neral cited and, with it, His Majesty the King.
With this the view has been raised until tomorrow, Wednesday,
in which Mr. López Montero will continue his presentation.
3. OTHER FACTS AND COMMENTS
The lack of interest on the part of the press, commissions and
observers, who especially at the beginning of the morning, are
ethically absent.
The role of the co-defensors - or military defenders - continues -
being, in addition to being inconcrete. of practically zero value, -
since, in situations they lack strength
za. and are of little expositional merit: Specifically, that of the
General Chamorro, in addition to deviating from his special defense
scientifically, has not contributed a single relevant point. ;
On the other hand, civil defenders, although with mixed presentations,
narrative and well-planned, they are excessively repetitive, producing
fatigue and lack of interest on the part of those who must listen--

In general, the position of the military organizations and commissions--
