(For Commander Cortina, the Fiscal Minister requests a - sentence of 12 years of military prison and separation from service. The defense lawyer his free acquittal). The lawyer who yesterday afternoon had refuted the first ra of the Prosecutor's accusations, continues in the use of - word to do the same with the second and third. The second is related to the meeting in the office of - Juan Gris Street, on Saturday, February 21 at 8:30 p.m. - hours, between Tcol. Tejero and General Armada. For this, the Mr. Villalonga, shows that the Public Ministry is based solely on the statement of Lieutenant Colonel Te- jero, and who mentions the fact for the first time at the hearing --- oral. The defender adds that although it is not his responsibility to prove - nothing, he does it and boasts that the testimonies provided in this point are true. The third accusation of the Prosecutor is the one related to the fact that By order of Commander Cortina, means had been provided, to a certain organization, for the fulfillment of the operation--- tion. The defense also says that the Public Ministry is based co in the declaration of Theol. Teiero, the fourth, and around to these I have in confusionism conscign\ you or incon To the section of the vehicle parked in double row in the Pa- seo de las Delicias, the “defender, calls it an unsupportable hypothesis nible. Next, review the telephone conversations (su- placed) between Madrid and Valencia that established who he was - Commander Cortina and the degree of trust he deserved. - In the statements that mention him there is only imprecision-- nes and contradictions. He then presents the point related to the office of the - State Security in which names and companies are referenced-- sas. Mr. Villalonga describes it as a "trade with a vice - of falsehood'", and requests certification from the Council to proceed - accordingly. Here a dialogue arises between defender and Pre- sident, for what he considers a pejorative allusion for - part of the Prosecutor when citing the expression "Cortina's girlfriend" to the young lady who is mentioned in the aforementioned office. Finally, the defense, criticizes and evaluates it---. tion of the test. In his criticism, he states that he does not understand the reason why the Public Ministry does not apply to his patron given the same reasons as others for not prosecuting them. It begins with a reference to political parties such as - cause of many of the people's ills, and with the reference cia to the honorary authority that the Constitution grants to the - King. The line of defense consists of analyzing the writing of the -- Prosecutor regarding the events of February 23 and 24, examined-- nar then the specific activity of the captain and make final-- mind some particularizations in relation to the Lieutenant -- Alonzo. Consequently, the lawyer follows the Prosecutor's story to to determine that the facts do not constitute rebellion. He then makes it clear that the time has come for that Captain Batista speaks to, on the one hand, make an act - of faith in military justice and, on the other, despising the - who have illegitimately charged against him (the press is sin-- noted). The defense lawyer enters into the attempt to dismantle by- in a minor way the weak - by him so called - accusation - of the Prosecutor. For this, it refers to the captain's first departure, -- with the mission of occupying the La Voz de Madrid radio station, like the compliance with an order. He then goes on to cite his particular concept of occupation. tion of a station, as a prior element to the analysis of the Captain Batista's second appearance at La Voz de Madrid. Highlighting that there was no such occupation due to: - Not having used force. - It is not true that he locked up the company's employees. and watch over them, as confirmed by the statement of three of the four witnesses presented. - He did not modify the programming, he did not impose programs, no ma manipulated devices and allowed normal operation. For all this, and because he limited himself to searching for information, - being authorized by command, there is no punishable crime. The rest of the time has been dedicated to talking about Reales Ordinances, Constitution, military virtues applied to their defended the 1action of DAC and DIMT 3, and issues s isia by the defenders what has OTHER FACTS AND COMMENTS +- As expected yesterday, given the tension with which the session today some incidents have occurred. - The unfavorable comments of commissions and defenders, before Mr. Villalonga's statements have been similar to those from the previous day. - When the hearing session was suspended, around 12 in the morning, na and upload the processed to the Residence, the Tcol. Tejero has questioned Cte, Cortina about the demonstrations that had been acting as his defender. There has been a harsh exchange of words and they have thrown to the hands, with some slight exchange of blows. - Other incidents have occurred in relation to the newspaper Mr. Martín Prieto, accredited at the hearing by the newspaper co EL PAIS. As a consequence of the chronicle that he inserted in today's issue, in which some observations were made - on the Laureate Cross of San Fernando of General Orozco Ma- sieu that have been considered derogatory, has been violently questioned by the lawyer Mr. Segura Fers (who has requested of the President of the Supreme Council to withdraw the accreditation tion to the informant) and by another military co-defender. - Likewise, the Togado Councilor Mr. Barcina has asked you to explain tions about a chronicle published at least two weeks ago, in which he stated that in a photograph obtained from Tcol. Te- jero when he was heading to the Military Government of Madrid to assist to go to the War Council for Operation "Galaxy", it can be appreciate how the wife of a Councilor (precisely that of the - Mr. Barcina, although such detail was omitted in the aforementioned chronicle nica) kissed the Lieutenant Colonel. Finally, and with an unconfirmed nature, the news circulated cia in the Rapporteurship that the President of the Supreme Council - had requested from the repeated Mr. Martín Prieto that in the si-- next chronicle to publish, rectify and give an explanation- formal tion to General Orozco. - The Prosecutor is being harshly attacked by the defenders, -- that constantly reiterate the idea that he himself affirms the facts without being proven in any way, - For this reason, and for the existing comment that it is not appropriate for there is a sentence before Armed Forces Day, circulates - the option (contrary to past dates) that it is very predictable There is likely to be a reply from the Prosecutor. - The same intention of delay is attributed to the possibility that, after the Prosecutor, a few days of rest be granted to give time help the defendants prepare for their possible intervention. - Colonel de Meer, defender of Captain Dusmet, repeats tirelessly ble that the sentences are going to be excessively high. the same opinion circulates among the military commissions, that, although ca- more and more it is adas. - Tiredness is general, so we see with great hope the possibility of finishing-the defenders next week. This fatigue causes a general nervousness that does not give rise to more incidents due to the small number of attendees. ace: or —
