ASUNTO: VISTA ORAL 2/81 DEL CONSEJO SUPREMO DE JUSTICIA MILITAR.
1.- DESARROLLO DE LA SESION CORRESPONDIENTE AL 10-05-82
A las 10'05 se inició la sesión.
Intervinieron sucesivamente los siguientes defensores:
- Comandante de la Guardia Civil Pardos Aldea, defensor del
Capitán del mismo Cuerpo Lázaro Corthay.
- Letrado Sr. Sanz Arribas, defensor de los Capitanes Bobis
González (de la Guardia Civil) y Cid Fortea (de Intenden-
cia).
o A
sición saludó militarmente a cuantos superiores. y mandos
do el Tcol.
Similares, no esten procesados.
nales.
a prestar apoyo moral y testimonial.
to de culpabilidad.

SUBJECT: ORAL HEARING 2/81 OF THE SUPREME COUNCIL OF MILITARY JUSTICE.
1.- DEVELOPMENT OF THE SESSION CORRESPONDING TO 05-10-82
At 10:05 the session began.
The following defenders intervened successively:
- Commander of the Pardos Aldea Civil Guard, defender of the
Captain of the same Corps Lázaro Corthay.
- Lawyer Mr. Sanz Arribas, defender of the Captains Bobis
González (from the Civil Guard) and Cid Fortea (from Intend-

45 minute interval) and in the afternoon at 5:00 p.m., -
once the intervention of Mr. Sanz Arribas has finished.

its Guards, and in helping the evacuation of people
who became unwell, leading them to the ambulances--

do the Tcol. Tejero terminated the service.
In the legal argument the defense rejects the -
qualification of rebellion applied to his client, who neither
did not take up arms or participate in any previous conspiracy -= —
na, and simply carried out orders received from a superior
hierarchical leader, asking for absolution. “a |
Finally the defender Comandante Pardos Aldea directed |
some considerations to the Court on the precedent that
would mean for the militia a sentence for obedience and dis |
cipline in accordance with the Regulations of the Body, and the Rea
the Ordinances.
2.2.Intervention of the lawyer Mr. José Luís Sanz Arribas, defense
sister of the Captain of the Civil Guard Bobis González and the
Captain of Quartermaster Cid Fortea.

military discharge and separation from service. The defense asks -
his free acquittal).
(Captain of the Civil Guard Bobis on 23-F was -
assigned to the G.C. Traffic Academy. and perform
take the Aptitude Course for promotion to Chief. The Captain
Cid was Cashier of the Nucleus of Divisional Troops of the -
DAC).
Mr. Sanz defends his clients -
separately. Start with Captain Bobis.
This defense is structured in a classical way: story
of the facts, existence of a crime and defenses.
E) subscribes to what was stated by
the Prosecutor but disagrees with the legal qualification that -
this day Thus, the behavior of his client divides it into three
parts: when you receive the order, it will arrive immediately--
tions of Congress and finally the presence of Captain
in Congress,
The order is received by the accused from a superior who -
is in uniform, which invokes high levels of the State and-
which is confirmed with widespread alarm in the Park.
With this approach the defense deduces the decision of sa
go to perform service under an order.
The part relating to the Captain's participation in
the events that occurred upon arrival at the Gi-
They revolve around misinformation and great silences
evidenced (enigmas of the History of Spain) by the -
commands of his client.
Finally, the conduct inside Congress -
It was collaborative: it comforted, encouraged and assisted.
The defense also expressed relative considerations
to the way in which in the Civil Guard:
. Orders require
. immediate compliance is required
. the service is fulfilled without the need to legitimize -
their condition, etc.
For all these reasons, Captain Bobis, according to the defense,
23-F was fulfilling an order and a duty.
He later developed a whole theory of ob-
due diligence with the nuance of lack of intent, to de-
tell the Council that it is up to him to cut the knot -
Gordian of the question: discipline in the readiness of the
obedience, since if it is not done it can lead to

finals.
Structure the defense in the narration of facts, in the
demonstration that there is a lack of typicality in the conduct followed
for its sponsored and finally in that it is not possible to exi
led Captain Cid Fortea to a different behavior.
In the story of the facts, the lawyer demonstrates
that in the DAC there was first joy and then disappointment--
tion, rage, indignation and even shame, which influenced
in the mood of his sponsored and provoked in him -
feelings of camaraderie and honor: go to Congress
to provide moral and testimonial support.
He then presents the theory that there is a lack of typi-
ity in the conduct followed by Captain Cid on the day -
of the proceedings, both in what Mr. Sanz understands for reasons
objective and subjective. Thus, it deduces that there is no action
only posture.
Afterwards, the defense develops the theory of "non-existence".
