> ARAP./19-04-82 INFORMATIVE NOTE ON THE ANNOUNCED PROVISIONAL FREEDOM OF SOME DESCENDANTS IN CASE 2/81 1.- The recent resolution of the C.S.J.M., which agrees the provisional release, without bail, of the accused Captain - of the Civil Guard Mr. Francisco Ignacio Román has caused - strangeness in the legal circles that closely follow the - vicissitudes of Case 2/81. This feeling does not derive from Ja freedom in itself but of the circumstances and the moment in which it has been decreed. 2.- Indeed; the two arguments that have transcended the question sa, refer to the amount of the penalty that the Prosecutor requested appointment for the trial (one year and six months) and at the time - who had been in preventive detention (one year and two months), who absorbs more than three quarters of the count's request na. If the C.S.J.M. relies exclusively on these reasons. could have ordered provisional release from said procedure sado, at the latest on the date on which the Prosecutor formalized - the writing of provisional conclusions, that is, the two last February. 3.- But it is, indeed, strange that, having not taken then no decision by the C.S.J.M. and without having occurred there are no substantial new developments in the development of the - proof of the trial that is being held, proceed inappropriately nothing, now, to decree freedom, without waiting for the sentence that must be handed down following the termination tion of the Judgment, now very close. 4. - It is known that c. J .}1. prescriptively imposes, the freedom provisional status only "in cases in which the accused is imprisoned preventively for a time equal to or less than the sentence that could correspond to him" (art. 691). This grief, like 2.- It is obvious, it is not quantified by the tax request but by the corresponding precept of the C.J. M. One and the other not have to necessarily be coincident, although - are generally. 5.- It must also be taken into account that art. 17.4, subsection fi nal, of the Constitution, establishes that "by Law it is determined The maximum duration of provisional detention will be determined. This Law has been promulgated for the ordinary procedure io by Law 16/80 of April 22, incomprehensibly does not extend given to military procedures in the C.J.M. reform. - operated by L.O. No. 9/80, November 6. In said Law - It is established, through the reform of art. 504 of the Law Criminal Prosecution, that "in no case does imprisonment pro vision could exceed half the presumptive time mind may correspond to the crime charged • For these purposes cough will be understood as a penalty that, due to the possible modifying circumstances, may correspond to the accused c. These not existing, in the opinion of the judicial authority "The time that corresponds to the average grade will be computed as time." 6.- Reduced, however, the issue to this exclusive processing vally, it would not have greater significance; among other reasons because his actions in the events, according to the narration - of the Prosecutor, was "episodic" and "tangential"; and it would not be inso crime, that the sentence considered his criminal participation - atypical (with the consequent acquittal ruling) or, at least, susceptible to a lower legal qualification, - alien to the crime of rebellion. 7.- If we have started talking about this case, it is because it constitutes You have a history of the other resolutions that are announced as probable and imminent, of provisional release of all two Civil Guard lieutenants indicted. This matter It is the one that seems delicate, important and necessary to us. of a special reflection. At this precise moment, the freedom agreement would have in the estimation of public opinion a single explanation: that of moral acceptance by the C.S.J.M. of the exo- • 3.- neration of responsibilities - in comparison with the nients of the D.A.C.- derived from the conversations for - the surrender on the morning of 23-F. And such a connection offers - a legally monstrous and demoralizing image from the perspective of social consciousness. It should therefore be avoided any occasion for establishing an interrelation between the two phenomena. 8.- On the eve of the completion of the Trial and the imminent sentence, are out of place - except for unexpected events - two of exceptional incidence - resolutions of this type - that indirectly appear as anticipations of the failure and that, due to their orientation, lend themselves easily to valuing them as patents of impunity with the consequent sensations of disenchantment, frustration and defeatism. 9.- We believe that the time limit set for prison provides~ tive in the ordinary procedure - half the duration time portion of the sentence, presumed appropriate - although it has no correct application to military procedure, it must be observed in practice by virtue of its constitutional emanation. Pe ro the penalty requested by the Prosecutor for those referred to had tes, after assigning them a substantial reduction in - applicable sentence (which is from twelve and a half to thirty years, according to art. 288 of the C.J.M.) through the application of art. 294 of the C.J.M. with the character of specific mitigating pri privileged, it is three years and one day in prison. Well then They are still far from reaching the border of the middle of the penalty that must entail immediate freedom, since That event would take place next August. 10.- From the above, it seems that freedoms should only be be believed in the sentence (for those who are acquitted or have served an equivalent time in preventive detention that of the conviction) or, eventually, upon admission to processing the caxation appeal before the Supreme Court. In this last timorous assumption, that freedom should be decreed at least of all those in which it is presumed that they reach the mi tad of the expected time of sentence before resolving the - resource.
